These Terms of Service (“Terms”) govern your access to and use of SmsBomber (“we”, “us”, or the “Service”), including our website, SMS tools, scheduling features, number protection, and contact options. By using the Service, you agree to these Terms and our Privacy Policy.

Agreement

If you do not agree to these Terms, do not use the Service. We may refuse service to anyone at any time.

The service

SmsBomber provides web-based tools and related content. Features, availability, limits, and behavior may change without notice. We do not guarantee uninterrupted, timely, or error-free operation.

Acceptable use

You may use the Service only in compliance with applicable laws and these Terms. You agree not to:

• Use the Service to harass, threaten, defraud, stalk, or abuse any person or entity.
• Send unsolicited or unlawful messages, or messages that violate carrier policies, telecom regulations, or others’ rights.
• Interfere with or disrupt the Service, other users, or networks or systems.
• Attempt unauthorized access to our systems, data, or accounts.
• Use the Service to distribute malware, phishing, or other harmful content.
• Misrepresent your identity or affiliation, or scrape or automate access in a way that burdens the Service without permission.

Your responsibility

You are solely responsible for your use of the Service and for messages or actions taken through it. You must obtain any required consent from recipients and comply with laws where you and they are located. We may suspend or restrict access if we reasonably believe these Terms or the law are being violated.

Opt-out and protection

To request that your number not be used with our tools, follow Protect your number. Listing or removal is subject to verification and operational limits described on that page.

Intellectual property

The Service, including branding, text, design, and software, is protected by intellectual property laws. You receive a limited, revocable, non-exclusive license to use the Service for personal, non-commercial purposes consistent with these Terms. No other rights are granted.

Third parties

The Service may link to or rely on third parties (for example, hosting, fonts, or messaging routes). We are not responsible for third-party sites, services, or charges from carriers or others.

Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, SmsBomber and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising out of these Terms or the Service shall not exceed the greater of (a) amounts you paid us for the Service in the twelve months before the claim, or (b) zero if no fees were paid.

Indemnity

You agree to defend and indemnify SmsBomber and its operators against claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.

Changes

We may update these Terms by posting a revised version on this page. The “Last updated” date at the top will change when we make material updates. Continued use after changes constitutes acceptance of the updated Terms where permitted by law.

Termination

We may suspend or terminate access to the Service at any time, with or without notice, including for breach of these Terms.

General

If any provision is held unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement regarding the subject matter here.
